Exclusions
- Cosign shall not liable under the Lease for the occurrence of any of the below:
- Tenant default caused by, resulting from or related to Tenant's inability to occupy the Apartment due to:
- Constructive eviction or breach of the implied warranty of habitability by the Company;
- Damage to the Apartment, surrounding areas, or access thereto, including but not limited to damage from environmental hazards, weather, natural disasters, fire, smoke, water, flooding, or hazardous materials; or
- Infestation of pests, vermin, or insects.
- Excluded Damages to the Apartment or Property
- Normal Wear and Tear
- Damage to or loss of personal property of the Company (subject to the inclusions and sub-limits included in this Agreement).
- Environmental hazards, including but not limited to fire, or water damage.
- Third-Party Claims or Damage
- Any claims or damage caused by third parties not directly related to the Tenant or Cosign.
- Fraud or Misrepresentation
- Any loss involving material misstatement, misrepresentation, or fraud by the Company, their representatives, or agents.
- Excluded Expenses or Fees
- Out-of-pocket expenses, including but not limited to fines, attorney's fees (subject to inclusions and sub-limits in the Agreement), administrative fees, lease termination fees, late fees, or any other fees not identified as covered in the Agreement.
- Any amounts not legally eligible to be withheld from a security deposit.
- Lease Modifications, Terminations, or Concessions
- Early termination of the Lease where the Company and Tenant agree to relinquish rent obligations.
- Any concessions, rent credits, free rent, or reductions in rent payable below the amount stated in the Lease.
- Extension, renewal, or changes to the Lease terms following a Tenant default.
- Rent Payment Issues
- Any amounts due under the Lease reduced or forgiven by the Company after execution.
- Non-Rent Related Disputes
- Any dispute between the Company and Tenant unrelated to the failure to pay rent or fees covered under this Agreement (e.g., repair of Damage, legal fees, or Holdover Coverage, subject to the inclusions and sub-limits included in this Agreement).
- Additional Exclusions
- Acts of terrorism
- Any fees or lost rent caused by Company's failure to comply with applicable law, as determined by a court or government agency with jurisdiction.
- Leases for short-term rentals, co-living communities (excluding approved student housing communities), temporary housing, or any lease providing temporary housing due to the Apartment's unavailability.
- Any sublets not approved by the Company at the inception of the Lease.
